ADA Title II

ADA Title II covers state and local government entities and, as of 2024, carries a formal Department of Justice rule requiring public-facing web content and mobile apps to meet WCAG 2.1 Level AA.

Title II applies to every part of state and local government: city and county websites, public schools and universities, courts, transit authorities, and public hospitals. The DOJ’s April 2024 rule sets two compliance deadlines based on population size: April 24, 2026 for most public entities, and April 26, 2027 for those serving fewer than 50,000 people.

The rule includes limited exceptions for archived web content, preexisting conventional documents, and some third-party content, but the default expectation is full WCAG 2.1 AA conformance across an entity’s digital footprint. Vendors and contractors who build sites for these entities are effectively held to the same standard.
